TERMS OF SERVICE (AGB) - KOZOROG™

SECTION 1 - ZERO-TOLERANCE POLICY, INTELLECTUAL PROPERTY & BRAND PROTECTION

All content, designs, graphics, text, branding, imagery, audio, video, product names, logos, technical specifications, and overall digital architecture present on this website are the exclusive, unregistered and/or registered intellectual property of KOZOROG™. Any unauthorized reproduction, duplication, resale, scraping, data-mining, reverse-engineering, or exploitation of our website, brand name, or product designs is strictly and unequivocally forbidden.

You agree under penalty of law not to transmit worms, viruses, malicious code, or engage in any cyber-attacks (including but not limited to DDoS, SQL injection, or cross-site scripting) against our infrastructure. Any breach, attempted breach, or suspected breach immediately terminates your access and subjects you to maximum civil liability, financial restitution for damages, and immediate criminal prosecution under Belgian and European cybersecurity laws. Furthermore, you are strictly prohibited from using our brand name or trademarks in any meta-tags, search engine advertising, or deceptive routing practices.

SECTION 2 - STRICT NO-RETURN, NO-REFUND, AND ALL-SALES-FINAL POLICY

Notwithstanding any consumer protection laws to the contrary, and to the maximum extent permitted by applicable Belgian and European commercial law, KOZOROG™ enforces an absolute, strict, and uncompromising NO-RETURN AND NO-REFUND POLICY.

By completing a purchase on this website, you explicitly acknowledge and agree that all sales are strictly final. Once an order is placed and the payment has been authorized, it cannot be modified, canceled, refunded, or returned under any circumstances whatsoever. This includes, but is not limited to, buyer's remorse, accidental purchases, incorrect sizing selected by the Customer, delays in shipping, or dissatisfaction with the product's subjective aesthetic appeal. We do not offer exchanges, store credit, or returns for any physical goods. You are solely responsible for reviewing all sizing charts, product descriptions, and technical specifications prior to finalizing your transaction.

SECTION 3 - SHIPPING, HANDLING, RISK OF LOSS, AND CUSTOMER LIABILITY

KOZOROG™ operates on a strict "Free On Board" (FOB) Shipping Point basis. This means that the absolute risk of loss, damage, theft, or delay for all purchased items passes directly and entirely to the Customer the exact moment the items are handed over to the postal carrier or shipping provider.

3.1 Shipping Costs: The Customer is 100% responsible for all shipping and handling costs. Under no circumstances will KOZOROG™ subsidize, refund, or cover shipping expenses.

3.2 Undeliverable Packages: If a package is returned to our facility due to an incorrect address provided by the Customer, failure to claim the package at a local depot, or refusal to pay customs duties, the Customer shall bear all return shipping costs. The Brand reserves the right to deem the product abandoned after 14 days of return receipt, with zero obligation to refund the original purchase.

3.3 Customs and Import Taxes: For international orders, the Customer is solely and exclusively responsible for any and all customs duties, import taxes, VAT, or tariffs imposed by their local jurisdiction. Refusal to pay these fees does not constitute a valid reason for a refund or return.

SECTION 4 - ABSOLUTE LIMITATION OF LIABILITY

KOZOROG™ shall not be held liable, under any legal theory (including but not limited to negligence, strict liability, breach of contract, or tort), for any direct, indirect, incidental, punitive, special, or consequential damages arising from your use of the website, the service, or any products procured using the service.

We do not warrant, represent, or guarantee that the quality of any products, services, information, or other material purchased or obtained by you will meet your subjective expectations, nor do we guarantee that any errors in the Service will be corrected. Our products are provided strictly on an "AS IS" and "AS AVAILABLE" basis without any warranties, express or implied, including but not limited to warranties of merchantability, durability, non-infringement, or fitness for a particular purpose, especially regarding extreme alpine or outdoor use.

SECTION 5 - PRICING, AVAILABILITY AND RIGHT OF REFUSAL

All prices, product descriptions, and product availability are subject to immediate change at any time without prior notice, at the sole discretion of the Brand. We explicitly reserve the right to limit the sales of our products to any person, geographic region, or jurisdiction.

We reserve the right to cancel any order or pre-registration at our sole discretion. We may limit or cancel quantities purchased per person, per household, or per order. In the event of suspected reseller, scalper, or automated bot activity, we reserve the right to confiscate funds as a penalty for violating our Terms of Service, cancel the order, and permanently ban the associated IP address and payment methods.

SECTION 6 - INDEMNIFICATION

You agree to indemnify, defend and hold completely harmless KOZOROG™, our founders, subsidiaries, affiliates, partners, officers, directors, agents, contractors, licensors, service providers, subcontractors, suppliers, interns and employees, from any claim, demand, lawsuit, or loss—including reasonable attorney’s fees—made by any third party due to or arising out of your breach of these Terms of Service or the documents they incorporate by reference, your violation of any law, or your infringement of the rights of a third party.

SECTION 7 - SEVERABILITY, WAIVER, AND ENTIRE AGREEMENT

In the event that any provision of these Terms of Service is determined by a court of competent jurisdiction to be unlawful, void, or for any reason unenforceable, such provision shall nonetheless be enforceable to the fullest extent permitted by applicable law, and the unenforceable portion shall be deemed severed from these Terms of Service. Such determination shall not affect the validity and enforceability of any other remaining provisions. The failure of us to exercise or enforce any right or provision of these Terms of Service shall not constitute a waiver of such right or provision.

SECTION 8 - GOVERNING LAW AND EXCLUSIVE JURISDICTION

These Terms of Service, and any separate agreements whereby we provide you Services or Products, shall be exclusively governed by, construed, and enforced in accordance with the laws of Belgium, explicitly superseding any local laws or consumer protection statutes of the Customer's country of residence.

Any disputes, claims, or legal proceedings arising out of or relating to these Terms or the Brand shall be subject to the exclusive jurisdiction of the competent courts of Belgium. By using this website, you irrevocably consent to the personal jurisdiction of such courts and waive any objections based on improper venue or forum non conveniens.
